
TERMS AND CONDITIONS
The following terms and conditions apply to all cakes made by Sarah Perks, trading as Cakes by Little Orchard Bakery.
Ingredients
It is recommended that sponge, flavoured and chocolate cakes are eaten on the day of the celebration. However if they are stored correctly may last an additional 3 - 4 days.
Whilst every effort is made to keep ingredients separate, all our cakes are made in an environment where nuts may be used and so cakes made may contain traces of nuts or nut oil. Please be aware that whilst your chosen cake may not specifically be made with nuts or a nut based product, it will be prepared in a kitchen where nut products may have been used. For this reason we cannot guarantee that your cake will be completely free from traces of nuts. It is the customers responsibility to inform Cakes by Little Orchard Bakery at the time of ordering if there are any special dietary requirements such as alergies etc. we cannot accept responsibility fir any illness or adverse reaction to ingredients if we are not made fully aware at that time.
Any additional toppers created for your cake will be made from a modelling sugar paste which becomes very hard and brittle once set. Whilst this ingredient is edible it is advised that extreme care is taken if you decide to consume the product, especially regarding dental matters.
Storage
Soft icing that may cover the cake, known as Sugar paste, is not designed to be refrigerated because it can cause the colours to run. Cakes should be stored in a cool dry place, preferably in an appropriate box. All cakes should be kept in a cool environment and covered once cut.
Orders
For wedding cakes we prefer a minimum of two months notice, unless we are in a position to agree shorter period.
Any cake made by us from a photograph of another cake maker's work will be our interpretation of that cake, not an exact reproduction of it.
Deposits
We require a 25% deposit on placement of your order. All deposits will be deducted from the final balance due, but deposits are non-refundable if the order is subsequently cancelled by you.
Payment of Final Balance
A further 25% of the cost is paid one month before the date on which the cake is due to be completed. This further sum is also non-fundable if the order is cancelled by you before the date the cake is due to be completed. The final 50% is paid on or before actual delivery or collection of the cake.
Cancellation
As stated above, the deposits are non-refundable nor transferable. Full payment for the cake is payable if you cancel the cake less than 14 days before the date that the cake is due to be completed.
It is the responsibility of the customer to ensure that we are in receipt of the notice of cancellation. Once notice of cancellation is received we will invoice you for any unpaid sums due from you in accordance with the terms and conditions referred to above, with appropriate legal action being taken for non-payment.
Failure on your part to choose a cake design one month before the due day for completion of the cake (or on making the order if there is less than one month available) shall be deemed to be cancellation of the order by you, resulting in the possible forfeiture of all or part of the deposits (or the full price) as referred to above.
Disputes
Complaints are extremely rare so we take them very seriously. This means they may require further investigation, so an immediate refund or part refund may not be possible. Any refund offered for disputes regarding the design or production of an item are completely at the discretion of Cakes by Little Orchard Bakery and are not automatic. We do not accept any responsibility for loss or damage to the item once it has been delivered or collected from my premises, or for loss, damage or non delivery under unavoidable or exceptional circumstances.
All disputes relating to forfeiture or return of deposits, cancellations, cake design or production of the cake shall be referred to arbitration under the appropriate legislation unless capable of resolution between us. The party liable for the cost of such arbitration will be as determined by the arbitrator.
Full refunds will never be given for any cake that has been consumed, since consumption is deemed to be acceptance that the cake was adequate for the purpose for which it was supplied.
Collection/Delivery
Cakes should be collected from our premises at a time to be agreed in advance. It may be necessary to make a small charge for delivery based on location and timing. CAKES NEED TO BE TRANSPORTED ON A FLAT SURFACE - the back seat of a car is unsuitable for transportation. Ideally the cake would be best transported on a passengers lap, or alternatively in a flat boot with supports around it to prevent the cake from moving during the journey. We cannot take any responsibility for any movement of or damage to the cake due to unsatisfactory transportation. A signature is required upon collection confirming you received your order in good condition and as specified.
All two tier cakes must be delivered by myself and a charge may be made based upon the distance of location.

We reserve the right to publish pictures of your cake on our Website, Facebook, Instagram and any other marketing media.
